Terms of Service
Effective Date: September 11, 2026
This Terms of Service agreement ("Terms") constitutes a legally binding agreement made between you, whether personally or on behalf of an entity ("Client," "you"), and The Levittown Link LLC, doing business as Bucks County Ads and Bucks County Deals ("we," "us," or "our"), concerning your access to and use of our advertising services, our agency website (buckscountyads.com), and our consumer directory hub (buckscountydeals.com).
By engaging our services, purchasing an advertising placement, or activating an auto-reloading marketing block, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using our services and must discontinue use immediately.
1. Description of Services
The Levittown Link LLC provides comprehensive multi-channel marketing solutions under three distinct brand divisions:
▪ Bucks County Ads: Provides direct mail and print marketing, ad design, graphic layouts, and both Business-to-Business (B2B) and Business-to-Consumer (B2C) advertising solutions (including 9x12 shared mailers).
▪ Bucks County Deals: Operates an informational, consumer-facing digital directory hub featuring local business discounts and promotions.
▪ Neighbor Blitz™ System: Provides the Complete Trifecta automated marketing system, B2B pay-as-you-go account fulfillment, and oversized postcards and matching door hangers launched natively via the Dispatch Terminal around active client job site locations.
2. SMS & Mobile Communications Agreement
By providing your phone number and opting in to communications via our web forms, chat widgets, or job dispatch entry, you expressly consent to receive operational and marketing text messages (SMS and MMS) from The Levittown Link LLC d/b/a Bucks County Ads.
▪ Message Types & Frequency: Messages include transactional alerts, dispatch updates, proof approvals, account alerts, and promotional marketing. Message frequency varies based on your account activity and campaign selections.
▪ Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier and wireless plan.
▪ Opt-Out Mechanics: You may opt out of receiving text messages at any time by replying STOP to any mobile message sent from our system. Upon sending STOP, you will receive a single confirmation message verifying your unsubscription.
▪ Support & Help Commands: For assistance, reply HELP to any message or contact our support team at 215-315-8310 or adam@buckscountyads.com.
▪ Carrier Liability: Wireless carriers are not liable for delayed or undelivered messages.
3. Ordering, Payment, and Account Models
Services are offered as One-Time Purchases or Auto-Reloading Marketing Blocks.
a. General Billing Policies: All service quotes are valid for a period of fourteen (14) days unless otherwise stated. Full payment is required before an advertisement is sent to print or published digitally. We accept major credit cards and bank debit cards via our secure merchant processors.
b. One-Time Engagements: For single purchases, payment is required in full at booking to secure placement. These engagements are strictly for a single mailing or 30-day digital cycle only. They do not grant a reserved spot in subsequent cycles or lock in current pricing for future purchases.
c. Auto-Reloading Block Accounts (Pay-As-You-Go): By enrolling in the Neighbor Blitz™ program (e.g., 250 Mailer Only Block or 250/250 Combo Block), you explicitly authorize Bucks County Ads to securely vault your payment method on file. Client accounts operate on a pay-as-you-go inventory system. When your dispatched mailer inventory successfully reaches zero, our payment system will automatically charge your vaulted card to reload your account with a fresh block of inventory. There are no monthly retainers or long-term commitments.
d. Price Adjustments & Notice Periods: We reserve the right to modify partnership pricing or change advertising structures at our discretion. We will provide you with at least thirty (30) days' advance notice via email prior to any package pricing adjustments taking effect. Continued participation in the marketing program following a price increase constitutes full acceptance of the new rate.
e. Strict B2B No-Refund & Cancellation Policy: Due to the highly customized nature of advertising space, software provisioning, print production, and data extraction, all sales are strictly final. This is a Business-to-Business (B2B) transaction; consumer "cooling-off" periods do not apply. Upon checkout, your payment immediately secures creative design labor, Dispatch Terminal server resources, and print inventory allocation. Therefore, payments are 100% non-refundable from the moment the transaction is processed. You agree not to issue chargebacks via your bank or credit card provider. Any illegitimate chargeback attempt will be aggressively contested using this legally binding agreement. Account Cancellation: If you wish to cancel an auto-reload account, you must do so using the designated cancellation feature located directly inside your secure Dispatch Terminal. Upon cancellation, your account will remain open, allowing you to dispatch any remaining inventory you have already purchased. Once your existing inventory is fully exhausted, your account will automatically close and no further charges will be applied. No partial refunds will be issued for unused inventory.
4. Print Advertising & Postal Distribution Specifications
a. Physical Print & Door Hanger Fulfillment Timelines: Physical print marketing materials are scheduled differently than automated mailers. Fulfillment and shipping for the 250 physical door hangers included in the Combo Block can take up to 10 to 14 days following final design approval.
b. Schedule Fluctuations: For postcard advertising services, the Publisher establishes a targeted mailing window for each distribution cycle. All mailing dates are approximations and are subject to change due to printing queues, paper availability, postage delays, or other technical factors beyond our reasonable control.
c. Mailing Lists: We acquire consumer mailing lists from reputable third-party data providers based on your specified target geographic or demographic criteria. While these providers maximize data filtering, you acknowledge that mailing lists are subject to natural margins of error, and we cannot guarantee 100% accuracy of every individual name or street address.
d. Postal Delivery Disclaimers: Our strict custody and liability for physical mail pieces ends completely the moment they are delivered to, and accepted by, the United States Postal Service (USPS). We are not responsible for USPS delivery performance, local mail carrier delays, weather disruptions, route anomalies, or physical damage. Documentation proving a formal USPS mail drop will be provided upon written request.
e. Neighbor Blitz™ Dispatch Terminal Automation & USPS Indemnification: The Neighbor Blitz™ program relies entirely on real-time address data submitted by the Client into their private Dispatch Terminal. The Client bears sole operational responsibility for the absolute accuracy of the job addresses entered. Bucks County Ads executes database mapping, print allocation, and postal fulfillment automated directly from the Client's exact terminal input. The agency is completely indemnified, and assumes no liability for, data errors, invalid routes, or printing costs resulting from Client typographical mistakes. No complimentary re-runs, replacements, or refunds will be granted for client-submitted address errors. Furthermore, while delivery pipelines are initiated immediately upon dispatch, actual delivery timeframes are subject to the United States Postal Service (USPS). The agency is entirely indemnified against postal logistics fluctuations, carrier delays, weather delivery pauses, or lost mail items once marketing materials enter USPS custody.
5. Digital Placement & Service Stability
a. Regional Feature Parameters: Single-month digital features remain active for a fixed window of thirty (30) days from the date of initial publication on buckscountydeals.com. Ongoing digital features renew indefinitely on a month-to-month cycle until canceled.
b. Technical Infrastructure Constraints: While we strive for 100% uptime and search engine visibility for the directory features hosted on buckscountydeals.com, you acknowledge that digital hosting services are subject to temporary disruptions due to vital software updates, server migrations, or internet network dependencies beyond our control.
c. Link Maintenance: You are solely responsible for ensuring that the destination web links, phone numbers, and promotion parameters provided for your digital feature remain accurate and operational on your end.
6. Client Responsibilities & Artwork Approvals
a. Content Ownership & Legal Clearance: You retain ownership of your pre-existing text, imagery, branding elements, and logos ("Content"). You represent and warrant that you own or possess all necessary licenses and permissions to distribute the Content provided to us.
b. Mandatory Proofreading: It is your sole responsibility to carefully proofread, review, and formally approve all final digital or print artwork proofs. The Levittown Link LLC is not liable under any circumstances for typographical errors, design omissions, bad contact data, or graphical inaccuracies once final approval has been granted.
c. Prohibited Material & Right to Refuse Service: You agree not to submit Content that is fraudulent, deceptive (such as bait-and-switch deals), infringing on third-party intellectual property, defamatory, or violative of state or federal statutes (e.g., FTC guidelines). We reserve the right, in our sole discretion, to refuse to design, print, host, or distribute any advertisement we deem objectionable, without any liability to you.
7. Intellectual Property & Usage Rights
a. Agency Ownership: All creative assets, ad concepts, source files, system code, custom graphic design layouts, and digital configurations built or compiled by Bucks County Ads remain the exclusive intellectual property of our agency.
b. Limited Usage License: Payment of your invoice or account block grants you a non-exclusive, non-transferable, Limited Usage License to display the finalized advertisement layout exclusively on authorized Bucks County Ads platforms, including our direct mail pieces and the buckscountydeals.com community hub, for the authorized duration of your campaign.
c. Unauthorized External Distribution: You are strictly prohibited from copying, scraping, reproducing, or republishing our custom designs, graphics, or layouts on external third-party platforms (including outside websites, social media, or other print media networks) without our express written consent.
d. Creative Release Fee: To obtain full, unrestricted ownership and usage rights for external multi-channel marketing campaigns, a one-time Creative Release Fee of $150.00 per individual ad design must be paid to the agency.
8. Indemnification & Limitation of Liability
You agree to defend, indemnify, and hold harmless The Levittown Link LLC, its affiliates, brand DBAs, officers, and employees from and against any third-party losses, legal claims, structural damages, or financial demands (including reasonable legal fees) arising from your advertisement Content, your business activities, or your breach of these Terms.
IN NO EVENT WILL THE LEVITTOWN LINK LLC, OR OUR DIRECTORS AND AGENTS, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOST REVENUES, LOST DATA, OR LOST PROFITS ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE STRICTLY LIMITED TO THE EXACT AMOUNT PAID BY YOU TO US FOR THE SPECIFIC INDIVIDUAL SERVICE INSTANCE GIVING RISE TO THE DISPUTE.
9. Governing Law & Local Jurisdiction
These Terms and your engagement of our Services are governed strictly by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law rules. Any legal suit, action, or proceeding must be instituted exclusively in the state courts of Bucks County, Pennsylvania, or in the United States District Court for the Eastern District of Pennsylvania.
